集体土地更新已成为我国城乡更新的重要领域。研究以广州为例,基于新制度经济学和经济社会学对土地产权的理论积淀,由表及里深入剖析半城市化地区非农化村庄改造中,集体土地利用转型的产权规则建构过程与困境。
研究内容包括:1)构建集体建设用地再开发的理论分析框架;2)剖析集体建设用地再开发的利益冲突形成机制;3)实证解析制度转型下集体建设用地再开发的特征;4)揭示产权规则建构视角下集体建设用地再开发的困境;5)提出集体建设用地再开发的治理优化与政策建议五部分。

前  言
  20世纪80年代以来,珠三角以村社为单位,在集体土地产权和土地股份合作制的治理环境下演绎了如火如荼的农村工业化进程。伴随着集体建设用地的蔓延扩张,农村地区低附加值产业集聚,土地使用低效锁定,城郊土地区位价值难以显现,土地租金沉淀。2008年以后,经过农村工业化后的集体建设用地更新成为珠三角城乡更新的主要议题。以村级工业园为代表的集体建设用地作为“产业经济空间”联动转型的载体,其更新改造对于珠三角半城市化地区的发展模式转型和农村综合改革意义重大。
  一直以来,集体土地再开发被当作一个土地开发权和财产权转让、重构,空间权益再分配的经济过程,研究大多数遵照西方制度经济学对土地产权、财产权利的研究范式,忽视了集体土地产权本身所内嵌的社会性和集体性特征对乡村土地利用转型的影响。乡村空间叠加着历史、文化、产权等多层次因素,乡村土地利用转型应关注乡村的内生基因。自上而下的集体土地再开发产权重构必然与乡村集体社区内生的产权认知产生冲突。广东省开展的三旧改造提供了一个审视集体土地再开发过程中产权规则建构过程的机会。
  基于集体土地产权的“集体性”“社会性”和“认知性”特征,产权规则建构视角下的集体建设用地再开发研究将产权的经济维度与社会维度联系起来,运用新制度经济学的产权理论和制度变迁理论,结合经济社会学对集体土地产权的理论,构建了一个产权规则建构的分析框架;进而以珠三角典型的半城市化地区番禺区为例,剖析土地制度转型背景下集体建设用地再开发所面临的困境及背后的成因,展现集体土地再开发在产权制度供给、经济利益分配和村庄社会转型过程中的冲突与困境。
